The two documents are read together, and where a matter touches both, the clauses do not contradict one another; each is applied to the part it governs.
If you use the site or our services on behalf of a business, a farm record or a public body, you confirm that you hold the authority to bind that organisation to these terms. Whether you act for yourself or for an organisation, the person named on the enquiry or order is responsible for the account, the messages and the agreed scope of any work Baugh FRDM, LLC performs.
You may use this website and request our survey services only if you are old enough to form a binding contract under the law of your location, which in most United States jurisdictions means being at least eighteen years of age. Survey operations involve aircraft, liability and real money, so minors may not commission work and children are not invited to register or submit enquiries.
Where you act for an organisation you further confirm that the organisation itself is not barred or restricted from doing business and that you hold the authority described above. The company reserves the right to refuse or stop service to any person or organisation at its reasonable discretion, subject to the law, and to decline a project that it cannot perform safely or honestly for the quoted purpose.
In these terms, the words we, us and the company all refer to Baugh FRDM, LLC. The words you and your refer to the visitor, the client or the organisation that this site and our services are provided to. A project is the fixed body of survey work described in an accepted quotation. A deliverable is any map, model, log, report, image set or data file we hand over as the result of a project. Ground control is the surveyed network of points against which the air survey is tied, and the site means the public web pages hosted at https://www.baughfrdm.lat. These definitions keep the clauses that follow brief and precise.
Any other capitalised term that is not defined here carries the ordinary meaning a reasonable reader engaged in agriculture, land surveying or drone operations would give it. Where a clause uses a defined term, that term keeps the same meaning every time it appears unless the clause clearly says otherwise, so the whole document stays consistent from start to finish.
You are responsible for the accuracy of the information you give Baugh FRDM, LLC at every stage of an enquiry and project. That includes the correct location and boundary of the ground to be surveyed, the identity of the parcel, the presence of obstructions, the type of crop or ground condition and any access restrictions the flight crew must respect. A survey is only as good as the ground truth it begins from.
Should you later discover that something you supplied was wrong, you must tell us without delay so the plan can be corrected before money and flight time are spent on the wrong target. Where an error in your provided information causes extra flight time, extra processing or a second visit, the cost of making good that work may be charged to the project at our prevailing rates, and these terms set that expectation clearly so there is no surprise at invoicing.
Baugh FRDM, LLC grants you a limited, revocable, non-exclusive licence to view and use the public pages of this site for lawful personal or internal business purposes. You may read the content, save it for your own reference and share a link to the site, but you may not copy substantial parts of the pages to republish them, take the design work for your own build, or scrape the site to build a dataset for resale.
This licence does not transfer any ownership to you. The company and its named developer BaughFrdm keep all rights in the site, its code, its arrangement and its content unless a right is handed over by an express deliverable agreement for a particular project. Any use beyond the licence granted here needs our written permission, and we may withhold or attach conditions to that permission at our sole discretion.
In using the website you agree not to do any of the following: post or transmit material that is unlawful, threatening, defamatory or infringing; attempt to gain unauthorised access to the server, another account or a protected part of the site; interfere with the operation of the site through viruses, overload or other disruption; or use the site to collect personal information about visitors without their consent.

Every project at Baugh FRDM, LLC starts from a written quotation. That quotation names the scope, the acreage or the block to be flown, the sensor and service to be used, the deliverable set and the price. If our crew finds that the true scope differs materially from what the quotation described, we will stop and present a revised quotation before doing extra billable work, rather than run up a bill you never agreed to.
Prices in a quotation are used for that project only and are not a standing rate for future work. Travel beyond the normal base of operations shown on the contact page, express scheduling, larger ground and additional ground control may each carry their own charge, and where such a charge applies it will be listed in the quotation you approve. No charge is incurred for work that was not described and accepted in writing.
A project begins when Baugh FRDM, LLC and you both accept a quotation for a defined piece of survey work. Your acceptance may be an email back, a signed quotation or a clear written instruction to proceed, whichever the proposal states. Until that moment there is no contract for the work, only an arrangement between us, and either side is free to walk away without penalty.
Once accepted, both sides hold obligations: we must perform the agreed work with reasonable skill and care and to the agreed schedule, and you must give clear access, accurate site detail and the agreed payment terms. If a dispute over whether a project began should arise, the written quotation and the record of your acceptance are the reference points that settle the matter.
Aerial survey depends on the sky, and no honest operator will fly in weather that endangers people or spoils the data. Launch dates are set for calm windows, and the final go decision rests with our launch master on the morning of the flight. Wind above the safe limit, low ceiling, active rain or a fast electrical storm all cancel a launch, and that is a judgement we make without apology.
When a launch is cancelled for weather or for an airspace restriction outside our control, we reschedule to the next available calm window rather than dropping the job. Cancellation for weather does not end the project and does not become a charge against you. Where your own site becomes unusable on a scheduled roll, for example through harvesting, construction or a locked gate, we will work with you to pick a new date at no added planning cost.
It is your responsibility to confirm that Baugh FRDM, LLC has lawful authority to survey the ground you ask us to fly. Where the ground is not yours, you must hold the permission of the owner or the manager for the crew to launch over or enter the property, and you must tell us about that permission before the flight. Surveying someone else ground without authority is not a risk we take.
You must also warn us of hazards the crew might otherwise miss, including overhead lines, guy wires, irrigation pivots, gates that need a key, dogs at large and ground that will not carry a vehicle after rain. A truthful brief makes a safe and smooth job, and it shields both the crew and the surrounding crop. If site conditions make work unsafe, the crew has the final word and will pause rather than push, and we will plan a safe return together.
When a project closes, Baugh FRDM, LLC hands over the agreed deliverables in the agreed formats. Unless a separate written agreement says otherwise, you own the finished mosaics, terrain models, index maps, quality sheets and plant indices produced for your project, and you may use them freely for your own agriculture, engineering or land management purposes.
The company keeps the underlying flight log, the processing methodology and the templates that made your job run, because those are the reusable machinery of the business, and no client money buys the company tools rather than the client products. Where you later want the raw source footage or the intermediate project files behind a delivered product, you may ask for them, and if the company can release them it will set a fair price for the transfer.
We take care to tie every delivered product back to surveyed ground control and to report the achieved accuracy on the quality sheet that ships with each package. That accuracy figure is honest and measured, not a boast pulled from thin air, and you should read it and plan around it. Where a stated accuracy range is important to your decision, check the quality sheet before you stake anything expensive on the map.
Because survey products are made from real measurements through a processing chain, no aerial product predicts every future surface exactly, and seasonal change, tilled ground and growing cover all move the numbers after the flight. Our deliverables describe the ground as it was at the time of the overpass. Use them as the strong base they are, and treat the date of capture and the stated accuracy as the bounds within which the work holds true.
The payment terms for a project are set in the quotation you accept. Many field projects run on a clear split schedule: a portion at booking to hold the crew and the weather window, and the balance on delivery once you have the finished products in hand. Invoicing follows the accepted quotation, and payment is due within the period shown on the invoice unless another arrangement is agreed in writing.
If a payment is not received by the due date, the company may pause work on current jobs, hold untransferred deliverables and place a hold on new flights until the account is brought current. Reasonable interest or a late charge may apply where the law allows and where the quotation said so. Straight talk is our habit, so if cash flow is a problem, telephone the office and talk it through before the date passes rather than going silent.
You may cancel a project before its first launch for any reason by writing to us clearly. Where work such as ground control, dedicated planning or travel has already been completed before your cancellation, that completed work is chargeable, because it was done in good faith to prepare your field. Where nothing has been spent on your project, we refund any booking payment in full and promptly.
Once a delivered product has been accepted and used, a refund is not available simply because you later change your mind about what the field should show. If a delivered product fails to meet the agreed scope or the stated accuracy because of error on our side, we will correct it at our cost or refund the affected part, and you will always tell us early if a deliverable does not look right so we can make it good while the ground still holds the truth.
Baugh FRDM, LLC provides the website and its survey services on the basis described in these terms, and to the fullest extent the law allows, you agree that our total liability to you for any claim connected with the site or a project, whether in contract, negligence or otherwise, will not exceed the amount you actually paid to us for the specific project or service that gave rise to the claim.
We will not be liable to you for indirect or consequential losses, such as lost crops, lost yield, lost opportunity, lost profit of a resale or any amount paid to a third party because a decision based on our product did not turn out as hoped. You are encouraged to seek independent ground advice before spending capital on a map, and to the extent your use of any deliverable requires professional judgement, that judgement sits with you and your own technical team.
You agree to defend, indemnify and hold harmless Baugh FRDM, LLC, its owners, employees, contractors and developer BaughFrdm from and against any claims, losses, costs and reasonable expenses that arise from your breach of these terms, from your use of the website, or from an act or omission in connection with ground you authorised us to survey.
That duty includes claims that arise because you held no authority over the ground, because you gave us a misleading hazard brief that endangered a crew or a neighbour, or because you used a deliverable in a way the licence given here does not allow. This clause does not require you to indemnify the company for its own negligence, but it fairly places on you the cost of a claim your own conduct brings about.
All intellectual property in the Baugh FRDM, LLC website, its layout, its written content, its branding and its processing templates belongs to the company or to BaughFrdm as the site developer, and nothing on these pages grants you a right to copy or reuse that work beyond the limited licence described earlier. The stencil marks, colour system and balloon motif that give the site its character are part of that protected property.
Where you licence the company to work off a drawing or boundary file you provided, that licence runs only for the period and purpose needed to complete your project, and your own underlying files remain yours. Good work feeds both directions, and these terms make sure each side keeps what it owns while enabling the honest partnership a survey job requires.

Please read it, because when you submit the contact form or instruct a project you are telling the company it may use your details in the ways that policy sets out.
Nothing in these Terms of Service overrides a privacy right the law gives you, and where you ask the company to correct or erase your data, the process in the Privacy Policy governs. The company will not sell your details, will not hand them to an unrelated party for their own marketing, and will treat your project records with the same care you would want for your own field books.
These Terms of Service are governed by the laws of the United States and of the state in which Baugh FRDM, LLC is registered, without regard to its conflict of law rules. Before resorting to any legal action, both sides agree to make a reasonable, good faith attempt to resolve a dispute through a direct conversation, and where that fails, through a short written exchange of the issue and a fair proposal. Because the terms of a particular project are fixed in the quotation you accept, a published change to these general terms does not rewrite the price or scope of a job already underway. Continuing to use the site after a revision means you accept the updated terms for future visits and future projects, while the project you already agreed continues under the terms that were in force when it began.
